The complaint filed by Noble claims that Michael O’Neill has a conflict of interest regarding health promotion because he is a member of a political party that is opposed to vaccinations. “The ACNC takes all complaints seriously and will investigate if there is evidence that a charity has failed to comply with its requirements,” said an ACNC official. Misty Mountain Aboriginal Healing Place, Misty Mountain Health and Education Institute, and other names have been used for the nonprofit since it was founded in 2012.

Michael O’Neill rebranded the former Misty Mountain Health and Education Institute as the Misty Mountain Health Retreat in 2017, according to documents filed with the Australian Securities and Investments Commission. Since the organisation “provides social services rather than education services,” O’Neill decided to reclassify it as a public benevolent institution, a subset of charities that can register as deductible gift recipients with the Australian Taxation Office and Acne.

Guardian Australia gave O’Neill a list of questions on the welfare services provided by the retreat and the payment methods accepted by vulnerable customers like Aboriginal and Torres Strait Islander people. These services cost anything from $2,450 for a single week to $8,800 for two weeks for two individuals. Additional services, such as a facial for $85 or a colonic irrigation for $100 per hour, are available for an additional fee.

O’Neill did not directly react to the questions but instead provided a screenshot of a letter supposedly written by an Aboriginal woman from Port Macquarie who worked casually at the camp. Without disclosing her identity, Guardian Australia chose not to name the woman. For example: “Michael O’Neill has sent me your email queries where you are seeking to put Misty Mountain Health Retreat in a negative light,” she wrote.

The charity’s annual report for 2018 shows that it received $400 in government assistance and saw its earnings drop from $120,278 in 2017 to $5,045 in 2018. Disclosures for 2014-2017 show they received $6,440 in funding from several government entities.

A spokesman from the Health Care Complaints Commission stated that Barbara O’Neill’s activities are currently under close scrutiny. Her restriction order prohibits her from “providing health education in any manner or offering health services,” he said. The states of New South Wales, Victoria, Queensland, and South Australia are all subject to the restraining order.
