Alito’s father, Samuel A. Alito, came from Italy to the United States and was ultimately the New Jersey legislature’s research director. His mother, Rose F. Fradusco Alito, was a teacher and principal of primary school. Alito graduated from Hamilton Township’s Steinert High School in New Jersey. He then graduated from Princeton University in 1972 with an A.B. Degree in History and Policy Science and a military commission (as a second lieutenant) at the U.S. Army Reserve. He was active for three months and inactive until he was released as a captain in 1980. Alito attended Yale Law School, where he edited the Yale Law Journal before graduating with a J.D. degree in 1975.

Alito’s professional career consisted nearly exclusively of serving the federal government’s judicial and executive departments. After graduating in law, he worked at a legal practise in Trenton, New Jersey, then as a clerk to the U.S. Court of Appeals on the Third Circuit under Judge Leonard I. Garth. He served as an assistant U.S. attorney for the New Jersey district from 1977 to 1981. He subsequently went to Washington, D.C., serving as a Solicitor General’s Assistant (1981-85) and Deputy Associate Procurator General (1985-87) inside the Ronald Reagan administration before returning to New Jersey to act as a US Procurator for the New Jersey District (1987-90). In 1990 President George H.W. Bush appointed Alito to the Third Circuit Court of Appeal and unanimously confirmed it in the American Senate. Alito sat as a judge on the Third Circuit for the next 15 years.

Pres. George W. Bush nominated Alito to replace the Supreme Court’s associate Sandra Day O’Connor in 2005, who plans to retire in 2006.

The hearings generated a lively debate about the limits of the Senate’s constitutional role to provide the President with ‘advice and consent’ when appointing the Supreme Court judges. In Alito’s case, the Republican Senate majority contended that the nominee’s professional qualities should be considered primarily, while the democratic minority maintained that the political ideology of the nominee should be taken into consideration. Finally an Alito appointment filibuster, emphasising its expected conservative judgments, was backed by a group of Democratic senators – included former and potential presidential contenders Hillary Clinton, John Kerry, and Barack Obama. But the leadership of the Republican Senate simply assembled the 60 votes needed for the cloture and Alito was confirmed by a vote of 58 to 42 on 31 January 2006. The vote was heavily partisan, only four Democrats voting in favour, and only one Republican voted against it.
