Merrick Garland Biography and Career:

Merrick Garland, whose full name is Merrick Garland Brian Garland, an American lawyer, judge, and government official who served as the Attorney General of the United States of America during the administration of President Joe Biden, was born on November 13, 1952, in Chicago, Illinois. He is a member of the Democratic Party. Formerly a judge on the United States Court of Appeals for the District of Columbia Circuit, Garland will now serve on that court (1997–2021; chief judge, 2013–20).

Garland was the grandson of Jewish immigrants who left the Pale of Settlement, the western territories of the Russian Empire to which Jews were limited at the time, in the early 1900s in order to avoid anti-Semitism. Garland was the grandson of Jewish immigrants. He received a degree in social studies from Harvard University, from which he graduated with honors and summa cum laude in the year 1974. While he was attending the renowned Harvard Law School, he worked his way up to the position of editor for the Harvard Law Review. After earning his law degree in 1977, Garland worked as a law clerk for the Honorable Henry J. Friendly of the United States Court of Appeals for the Second Circuit (1977–1988) and for the Honorable William J. Brennan, Jr. of the Supreme Court of the United States (1978–79).


Garland was appointed as a special assistant to the United States Attorney General Benjamin R. Civiletti in the year 1979. He served in that capacity until 1981, when he joined the Arnold & Porter law firm in Washington, District of Columbia. Between the years 1989 and 1992, Garland held the position of assistant United States Attorney for the District of Columbia. After that, he had a career that took him to the Department of Justice under the leadership of President Bill Clinton.

Garland oversaw several major prosecutions for acts of domestic terrorism while serving as the principal associate deputy United States Attorney General beginning in 1994. One of these prosecutions was that of Timothy McVeigh and Terry Nichols for the 1995 bombing of the Alfred P. Murrah Federal Building in Oklahoma City, Oklahoma, which resulted in the deaths of 168 people. Garland was also in charge of supervising the trial of the so-called Unabomber, Ted Kaczynski, who carried out a bombing campaign in the United States that lasted for 17 years and resulted in the deaths of three people and injuries to 29 more.

In 1995, President Clinton nominated Garland for a position on the United States Court of Appeals for the District of Columbia Circuit. However, because of a disagreement on whether or not to fill the available seat on the court, Republicans in the Senate decided to delay the nomination. Garland was finally approved by the Senate, which did so by a vote of 76 to 23 in 1997. Garland cited John Marshall, Oliver Wendell Holmes, Jr., and Brennan as significant influences on him during his confirmation hearing.  After taking his place on the court of appeals, Garland quickly earned a reputation for being a judge who maintains a middle ground.

In February of 2013, he was promoted to the position of the chief judge. In a significant decision that year, Garland ruled in favor of the American Civil Liberties Union (ACLU) in a case in which the ACLU sought documents from the Central Intelligence Agency regarding the use of drone strikes in counterterrorism operations. Garland’s decision was a victory for civil libertarians everywhere. In a number of other high-profile instances, Garland sided with the federal government and rendered favorable decisions. For example, in 2015, he led the court in upholding the implementation of long-standing legislation by the Government Election Commission that prevented federal contractors from making donations to political races. This statute had been in place for quite some time.

The passing away in February 2016 of Associate Justice of the Supreme Court Antonin Scalia presented former President Barack Obama with the chance to replace one of the most conservative justices on the Supreme Court. In March, President Obama proposed Merrick Garland to replace Antonin Scalia on the Supreme Court; however, Senate Republicans, who at the time possessed a majority in the chamber, refused to even schedule a vote or have hearings on Garland’s nomination. They were holding out hope that a Republican will win the presidency in 2016 and appoint a more conservative judge to the Supreme Court.

Legal analysts noted out that the reluctance to vote on a nominee for the Supreme Court was unusual in modern times, and many Democrats decried the blockage that the Senate Republicans were putting up. Donald Trump, the nominee for the Republican party in the presidential election, was victorious in November. Shortly after being inaugurated in as president, Donald Trump announced his intention to nominate Neil Gorsuch, a conservative judge on an appellate court, for the vacant seat on the Supreme Court. In April of 2017, the Senate voted to approve Gorsuch after Republicans defeated a filibuster by Democrats by abolishing the conventional sixty-vote threshold required to invoke cloture (to end debate and proceed to a vote).

Garland served as the chairman of the Executive Committee of the Judicial Conference of the United States, which is the administrative governing body of the federal court system in the United States, from 2017 to 2020. In February of 2020, he resigned his position as chief judge of the District of Columbia Circuit Court of Appeals, although he remained to work on the court in another capacity. Joe Biden, a Democrat, was victorious against Donald Trump in the presidential election that took place on November 3, 2020. Garland was presented with a nomination for the position of the attorney general of the United States by Vice President-elect Joe Biden. During his confirmation hearing before the Senate Judiciary Committee in February 2021, Garland claimed that one of his major responsibilities as attorney general would be to resist “extremist assaults on our democratic institutions.”

He was referring, in particular, to the assault on the United States Capitol that took place on January 6, 2021. During that incident, a violent crowd of Trump supporters rushed the building while Congress was in the process of confirming Biden’s win in the 2020 election. In their challenge to the election results, Trump and his supporters cited allegations of voting fraud that could not be verified. Garland has said that, should he be approved for the position, he would conduct a comprehensive inquiry into what he has described as “a terrible attempt that aimed to disrupt a cornerstone of our democracy: the peaceful transition of power to a freshly elected administration.” On March 10, 2021, there was a vote in the Senate that went 70–30 in favor of confirming Garland’s nomination as attorney general.
